What is BIPA?

BIPA was part of a broader effort to strengthen the nation’s healthcare programs. To ensure high quality treatment and to protect the integrity of the healthcare system, BIPA implemented programs to prevent fraud and abuse.

Benefits Improvement and Protection Act (BIPA)

In accordance with the provisions of the Benefits Improvement and Protection Act of 2000, known as BIPA, the posting and data collection requirements for skilled nursing facilities (SNFs) and nursing facilities (NFs) differ between the 2003 and 2005 versions of the law. If your facility incorporates PPD into scheduling, you must choose between the 2003 BIPA posting requirements and the 2005 BIPA posting requirements.

The postings display nurse staffing requirements, indicating licensed and unlicensed caregivers, enabling visiting surveyors to quickly assess the facility's compliance with the law. You will need to determine which set of posting requirements best suits the needs of your individual institution. However, once you opt for either the 2003 or 2005 BIPA, you must adhere to your chosen version; switching between them is not permitted.
